Supervisor Ken Vogel <br />8/2512011 <br />30f3 <br />workers performing cultivation activities on the Galeazzi walnut orchard.They had never set <br />foot onto the VanDykes'property. <br />CONCLUSION <br />The VanDykes pose a danger to themselves as well as others.Without a proper <br />emergency access road they are exposing themselves and San Joaquin County emergency <br />responders to undue safety hazards which could lead to loss of life.To date,however,they have <br />failed to obtain a Certificate of Occupancy from San Joaquin County and are continuing to <br />occupy their residence illegally. <br />Moreover,their antiquated and improperly located septic system continues to jeopardize <br />the Galeazzis'walnut orchards and livelihood. <br />The Van Dykes'failure to comply with their obligations leaves the Galeazzis with no <br />choice but to look to San Joaquin County to properly enforce its codes or assume the <br />responsibility for not enforcing them.More specifically,the Galeazzis respectfully request that <br />the County immediately take all required steps to prohibit the Van Dykes from illegally <br />occupying their residence and continuing to expose San Joaquin County and others to substantial <br />liability. <br />The question now is whether San Joaquin County will condone such illegal conduct or <br />require the Van Dykes to first obtain their Certificate of Occupancy.Since 2005,the Van Dykes <br />have been given every opportunity to obtain the necessary approvals for their occupancy,but <br />they have failed to do so.They do not have the right to continue to flout San Joaquin ordinances, <br />jeopardize the safety of emergency personnel and expose the County and the Galeazzis to <br />unacceptable tort liability. <br />Thank you for your assistance in this urgent matter. <br />cc Mr.and Mrs.Galeazzi <br />San Joaquin County Community Development <br />San Joaquin County Public Works <br />David VanDyke,Esquire
