Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's MEDICAL WASTE <br />DISPOSAL activities, are pursuant to Health and Safety Code section 25181 hereby permanently <br />~ ~ enjoined from: <br />a. Storing hazardous waste onsite longer than one hundred eighty (180) days, in <br />violation of California Code of Regulations, title 22 section 66262.34(d); <br />b. Transporting or causing the transportation of hazardous or extremely hazardous <br />waste to a point which is not authorized, in violation of Health and Safety code sections 25189.2(b); <br />c. Accepting, treating, storing or disposing of hazardous waste at a facility without <br />holding a hazardous waste facility permit, in violation of Health and Safety Code section 25201(a); <br />and <br />d. Failing to determine if that waste is a hazardous waste, in violation of California <br />Code of Regulations, title 22 section 66262.11. <br />4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br />are doing business in the State of California, in the course of Defendant's MEDICAL WASTE <br />DISPOSAL activities, are pursuant to Health and Safety Code section 25515.6 hereby permanently <br />enjoined from: <br />a. Failing to complete andJor submit a site map, in violation of Health and Safety <br />Code section 25505(a)(2): <br />b. Failing to submit emergency response plans and procedures for a release or <br />threatened release of a hazardous material, in violation of Health and Safety Code section <br />25505(a)(3); <br />c. Failing to provide training for all new employees and annual training, including <br />refresher courses, for all employees in safety procedures in the event of a release or threatened <br />release of hazardous material, in violation of Health and Safety Code section 25505(a)(4); <br />d. Failing to have emergency response plan and procedures, the inventory of <br />-2- <br />PERMANENT INJi1NCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
