The following is an itemized list of hazardous materials violations that have not been <br /> addressed for GRADUATE, THE as of May 04, 2016. <br /> Open violations from June 03, 2015 inspection <br /> Violation#2 -Failed to electronically submit a business plan. <br /> The facility's business plan, with all of the required information, was not submitted electronically to the California <br /> Environmental Reporting System (CERS) for the years 2013, 2014 and 2015. As of January 1, 2013, all businesses <br /> were required to submit all business plans electronically. Immediately log into the CERS at http://cers.calepa.ca.govi <br /> enter the correct or updated information, and submit to the EHD for approval. <br /> Violation #3 - Failed to annually review and certify that the business plan is complete,accurate, and up to <br /> date. <br /> The business plan information has not been completed, reviewed, certified and resubmitted in the California <br /> Environmental Reporting System (CERS) annually for the years 2013, 2014 and 2015. The hazardous materials <br /> inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of th <br /> previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, <br /> and submit to the EHD for approval. <br /> Violation#7-Failed to complete and/or submit hazardous materials inventory for all reportable materials <br /> on site. <br /> Carbon dioxide stored in a 400 pound bulk storage container, four 50 pound and two 20 pound cylinders were found <br /> site that have not been reported for the years 2013, 2014 and 2015. Any material that meets or exceeds the <br /> reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental <br /> Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and <br /> submit to the EHD for approval. <br /> Violation#11 - Failed to establish and/or submit emergency response procedures for a release or <br /> threatened release. <br /> The emergency response procedures have not been submitted for the years 2013, 2014 and 2015. A business plar <br /> shall include the following emergency response procedures for a release or threatened release of hazardous materia <br /> including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department(EHD) <br /> -procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Violation #12-Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program has not been submitted for the years 2013, 2014 and 2015. Training programs for all employees <br /> and annual training, including refresher courses, shall include safety procedures for the event of a release or <br /> threatened release of a hazardous material, including, but not limited to, familiarity with the facility's emergency <br /> response plans and procedures. These training programs may take into consideration of each employee. <br /> Immediately prepare or update the facility's training program, log into the California Environmental Reporting System <br /> (CERS)at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br /> Page 1 of 1 <br />
