However, our records indicate that your business has not
been in compliance in prior years. The requirements of Chapter 6.95 of the California Health
and Safety Code took effect in 1986. In these circumstances, County ordinance requires billing
of back fees to 1991 or to the year that our records show your business exceeded program
quantities for hazardous materials. Back fees are calculated based on your current year fee
calculations.
If you have proof that your business was not in operation in San Joaquin County during this
period, or that you did not handle hazardous materials in the regulated quantities, you can have
your back fees adjusted. Please call us with such information.
Attached you will find a bill for current year and back fees. Please remit your payment to the
Office of Emergency Services within 45 days of receipt of this letter. A 10% late fee will be
assessed for delinquent payments if not postmarked by the due date.
If a business is unable to pay the HMMP fee in one payment, they will be given the opportunity
to make payments according to a set payment schedule. These payments will include a 10% late
penalty. Please contact our office to make arrangements.
By law, all building permits must be reviewed for compliance with the provisions of Chapter
6.95 of the California Health and Safety Code. If a business is delinquent in their annual fee, it
could lead to delays or rejection of the permit process.
Should you have any questions, please call us at (209) 468-3969. Thank you for your
cooperation in helping to enhance public safety and the safety of emergency responders.
Remember that HMMP changes must be reported to OES within 30 days after the change is
made.
SAN JOAQUIN COUNTY OFFICE OF EMERGENCY SERVICES
Attachment
