#21) Failed to keep hazardous waste containers closed except when adding or removing waste. -Outside, the DE tank was open. This is a violation of CCR, Title 22, Section 66265.173(a). A container holding hazardous waste shall always be closed during transfer and storage, except when it is necessary to add or remove waste. Immediately, provide a way to close this tank. #27) Failed to keep signed copy of manifests for 3 years. This is a repeat violation. Gary Cummings was unable to provide any manifests for the past three years. Records of all hazardous waste disposal shall be kept for 3 years. This is in violation of CCR 66262.40. #30) Failed to keep a copy of a consolidated manifest for 3 years. This is a repeat violation. Gary Cummings was unable to provide any consolidated manifests for the past three years. Records of all hazardous waste disposal shall be kept for 3 years. This is in violation of HSC 25160.2. #31) Failed to keep a copy of manifest or bill of lading for lead acid batteries for 3 years. No records of lead acid battery disposal were available for reviews. Records of all hazardous waste disposal shall be kept for 3 years. This is in violation of CCR 66266.81(a)(4)(B). #49) Personnel training records incomplete. Sierra Chemical was unable to provide personnel training records for the current year. This is in violation of CCR, Title 22, Section 66265.16(b)(c)(d)&(e). Facility personnel shall be trained in hazardous waste management procedures within 6 months of assuming their position, they shall take part in annual training, the owner and operator shall maintain the training documents at the facility, and the training records for all employees handling hazardous waste shall be kept until closure of the facility. ALL VIOLATIONS MENTIONED ABOVE MUST BE CORRECTED WITHIN 30 DAYS, UNLESS OTHERWISE STATED IN REPORT, AND A RETURN TO COMPLIANCE CERTIFICATION (provided on the back of page 1) SHALL BE SUBMITTED TO THIS OFFICE WITHIN 35 DAYS OF RECEIPT OF THIS REPORT.
