1 4.8 Hazardous Waste,Hazardous Materials <br /> 2 4.8.a. Flying J shall comply with its employee training obligations as set forth in <br /> 3 California Code of Regulations,title 22,section 66265 16 pertaining to hazardous wastes, <br /> 4 including its obligation to maintain training documentation. <br /> 5 4.8.b. Flying J shall not treat,store,dispose of,transport or offer for <br /> 6 transportation,hazardous waste without having received an Environmental Protection Agency <br /> 7 Identification Number as required by California Code of Regulations, title 22,section <br /> 8 66262.12(a). <br /> 9 4.8.c. Flying J shall determine if a generated waste is a hazardous waste as <br /> 10 required by California Code of Regulations, title 22,section 66262.11 <br /> 11 4.8.d. Flying J shall not store on-site hazardous waste generated as part of its <br /> 12 operations for a period longer than ninety(90)days without a permit as required by California <br /> 13 Health and Safety Code sections 25123.3(a)(4)(b)and 25201(a). <br /> 14 4.8.e. Flying J shall properly label containers of hazardous waste as required by <br /> 15 California Code of Regulations,title 22,section 66262.34 <br /> 16 4.8.f Flying J shall keep containers of hazardous waste closed except when <br /> 17 removing or adding hazardous waste as required by California Code of Regulations,title 22, <br /> 18 section 66265 173- <br /> 19 4.8.g. Flying J shall maintain adequate aisle space in hazardous waste <br /> 20 accumulation areas as required by California Code of Regulations, title 22,section 66265.35 <br /> 21 4.8.h. Flying J shall retain copies of all consolidated hazardous waste manifests <br /> 22 for three(3)years as required by Health and Safety Code section 25160.2(b)(3). As used in this <br /> 23 Paragraph,"manifest"means a shipping document originated and signed by a generator of <br /> 24 hazardous waste that contains all of the information required by law and that complies with all <br /> 25 applicable federal and state regulations including,but not limited to,bills of lading. <br /> 26 4.8.i. Flying J shall comply with its employee training program instituted <br /> 27 pursuant to Health and Safety Code section 25504(a)(c)and California Code of Regulations,title <br /> 28 19,section 2732 pertaining to hazardous materials business and area plans. <br /> CONSENT JUDGMENT <br /> 12 <br />
