I prevent the court and creditors, including the third parties whose assets are held there, from <br /> 2 understanding what is there, and to allow the Debtor to "keep its option open" in terms of <br /> 3 characterizing what it has possession of and who owns what. <br /> 4 11. The original Schedules (November 19, 2008) and first set of amended <br /> 5 schedules (December 2, 2008) both included a detailed two page statement showing wine <br /> 6 inventory as of the petition date totaling $464,895. <br /> 7 12. In the February 2009 Monthly Operating Report (filed April 6, 2009), the <br /> 8 Debtor finally provided a new statement of wine inventory. It reveals, although not <br /> 9 admitted by the Debtor, that the Debtor claimed wine owned by third parties as its own <br /> 10 property, both prior to the petition and in the Schedules filed in this case. This is <br /> particularly apparent as to wine held in tanks.
