Violation of Health and Safety Code §25503.5(a), being a business that handles a <br />hazardous material or a mixture containing a hazardous material that has a quantity at any one time during <br />the reporting year equal to, or greater than, a total weight of 500 pounds, or a total volume of 55 gallons, or <br />200 cubic feet at standard temperature and pressure for compressed gas, including but not limited to <br />CALCIUM OXIDE, PHOSPHORIC ACID, failed to establish and implement a business plan for emergent. <br />response to a release or threatened release of a hazardous material for 2346 MAGGIO CIRCLE, LODI, <br />CALIFORNIA; <br />b. Violation of Health and Safety Code §25504(b), business plan failed to include <br />response plans and procedures in the event of a reportable release or threatened release of a hazardous <br />material, including but not limited to the following: <br />1. Immediate notification to the San Joaquin County Office of Emergency Services <br />and to the appropriate local emergency rescue personnel; <br />2. Procedures for the mitigation of a release or threatened release to minimize any <br />potential harm or damage to persons, property, or the environment; <br />site; <br />3. Evacuation plans and procedures, including immediate notice, for the business <br />c. Violation of Health and Safety Code §25504(c), failed to train all new employees and <br />annual training, including refresher courses, for all employees in safety procedures in the event of a release <br />or threatened release of a hazardous material, including, but not limited to, familiarity with the plans and <br />procedures specified in Health and Safety Code §25504; <br />d. Violation of Health and Safety Code §25505, failed to submit a business plan for <br />emergency response to a release or threatened release of hazardous material for the year 2005 for 2346 <br />MAGGIO CIRCLE, LODI, CALIFORNIA, to the San Joaquin County Office of Emergency Services. <br />Further, it is alleged that said violation was knowingly committed after reasonable notice; <br />e. Violation of Health and Safety Code §25505(e)(2), failed to annually submit a form, <br />provided by the San Joaquin County Office of Emergency Services, that certifies that the handler has <br />included, and maintains as current, in the business plan, all other information required by Health and Safety <br />2. <br />
