TELEPHONE(209)953-6200 <br /> FAX(209)953-6268 <br /> January 26,2012 <br /> RAY FARMER ENTERPRISES <br /> 3810 FOURTEEN MILE DR <br /> STOCKTON, CA 95219 <br /> SUBJECT: NON-COMPLIANCE OF LESSEE: <br /> CALIFORNIA AUTOTECH <br /> 510 E MINER AVE STOCKTON, CA 95202 <br /> Chapter 6.95, Division 20, Section 25500 et. seq. of the California State Health& Safety Code <br /> (commonly known as AB2185) requires businesses handling hazardous materials at or above the <br /> threshold limits to submit a Hazardous Material Management Plan (HMMP) and Chemical Inventory <br /> to the local Administering Agency. The Office of Emergency Services (OES) is the Administering <br /> Agency for San Joaquin County. <br /> Section 25503.6 of the California State Health& Safety Code requires lessees to provide a copy of <br /> their Hazardous Material Management Plan to property owners as follows: <br /> Any business which is required to establish and implement a business plan <br /> pursuant to Section 25503.5 and is located on leased or rented real property <br /> shall notify, in writing, the owner of the property that the business is subject <br /> to Section 25503.5 and has complied with its provisions, and shall provide a <br /> copy of the business plan to the owner or the owner's agent within five <br /> working days after receiving a request for a copy from the owner or the owner's agent. <br /> OES has attempted to collect a Hazardous Material Management Plan and Chemical Inventory from <br /> the business owner(s) California Autotech located at 510 E Miner Ave. Businesses which do not <br /> submit requested information in a timely manner are referred to the District Attorney's Office. <br /> California Autotech has not complied with the business plan requirements. <br /> Should there be a significant hazardous materials incident at this site, liability could be incurred by the <br /> property owner.
