A business plan shall include the following <br /> emergency response procedures for a release or threatened release of hazardous materials, including, but not <br /> limited to, the following: <br /> - Immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> - Evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the business plan is complete, accurate, and up to date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS) annually. The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 12 HSC 25505(c) Failed to have the business plan readily available to facility or EHD personnel. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures, the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section. Immediately make arrangements to have the business <br /> plan readily available for review. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, within 30 days of receiving the completed inspection report. <br /> At this location since at least 2014. <br /> Assisted with CERS account setup and submittal of the Facility Information Section at the time of inspection. <br /> Please be aware as of January 1, 2013, all businesses were required to submit all hazardous materials <br /> information online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
