EARHART AVENUE, SUITE 300 STOCKTON, CA 95206 TELEPHONE (209) 953-6200 FAX (209) 953-6268 May 27, 2009 PROLOGIS 17284 W COMMERCE WAY TRACY CA 95377 SUBJECT: NON-COMPLIANCE OF LESSEE: THE WINE GROUP 1111 RUNWAY DR #5, STOCKTON 95206 Chapter 6.95, Division 20, Section 25500 et. seq. of the California State Health & Safety Code (commonly known as A132185) requires businesses handling hazardous materials at or above the threshold limits to submit a Hazardous Material Management Plan (HMMP) and Chemical Inventory to the local Administering Agency. The Office of Emergency Services (OES) is the Administering Agency for San Joaquin County. Section 25503.6 of the California State Health & Safety Code requires lessees to provide a copy of their Hazardous Material Management Plan to property owners as follows: Any business which is required to establish and implement a business plan pursuant to Section 25503.5 and is located on leased or rented real property shall notify, in writing, the owner of the property that the business is subject to Section 25503.5 and has complied with its provisions, and shall provide a copy of the business plan to the owner or the owner's agent within five working days after receiving a request for a copy from the owner or the owner's agent. OES has attempted to collect a Hazardous Material Management Plan and Chemical Inventory from the business owner(s) of The Wine Group located at 111 IRunway Dr #5. Businesses which do not submit requested information in a timely manner are referred to the District Attorney's Office. The Wine Group has not complied with the business plan requirements. Should there be a significant hazardous materials incident at this site, liability could be incurred by the property owner.
