The facility's business plan was not submitted electronically to the California Environmental Reporting System (CERS). As of January 1, 2013, all businesses were required to submit all business plans electronically. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 5 HSC 25506(a) Failed to complete and/or submit hazardous materials inventory for all reportable materials on site. Large CO2 tank was found on site that have not been reported. Facility only has 35 gallons listed in CERS. Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. This is a minor violation. 7 HSC 25505(a)(3) Failed to establish and/or submit emergency response procedures for a release or threatened release. The emergency response procedures were lacking or inadequate. Regional water board phone number was lacking. A business plan shall include the following emergency response procedures for a release or threatened release of hazardous materials, including, but not limited to, the following: - immediate notification of local emergency personnel and the Environmental Health Department (EHD) - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment - evacuation plans and procedures, including immediate notice, for the site Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. This is a Class II violation. 9 HSC 25508.2 Failed to annually review and certify that the business plan is complete, accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year.
