1 business in the State of California and confined to Defendant's GASOLINE STATION activities in <br /> 2 the County of San Joaquin and elsewhere in the State of California. <br /> 3 3. Defendant,with actual or constructive knowledge of this Injunction,only in so far as they <br /> 4 are doing business in the State of California,in the course of Defendant's GASOLINE STATION <br /> 5 activities, are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br /> 6 a. Failing to retain a copy of consolidated manifest for at least three(3) years, in <br /> 7 violation of Health and Safety Code section 25160.2(b)(3); <br /> 8 b. Storing hazardous waste onsite longer than one hundred eighty(180) days,in <br /> 9 violation of California Code of Regulations,title 22 section 66262.34(d); <br /> 10 c. Failing to have at all times at least one employee either on facility premises or on <br /> 11 call with the responsibility for coordinating all emergency response measurers,in violation of <br /> 12 California Code of Regulations,title 22 section 66262.34(4)(2); <br /> 13 d. Failing to maintain a copy of the modified contingency plan at the facility,in <br /> 14 violation of California Code of Regulations,title 22 section 66262.34(d)(2); <br /> 15 e. Failing to retain a copy of each signed manifest for three(3)years or until the <br /> 16 generator receives a signed copy from the designated facility which received the waste,in violation <br /> 17 of California Code of Regulations,title 22 section 66262.40(x); <br /> 18 f Failing to contact the transporter and/or the owner or operator of the designated <br /> 19 facility to determine the status of the hazardous waste within thirty-five(3 5) days of the date the <br /> 20 waste was accepted by the initial transporter without a copy of the manifest with the handwritten <br /> 21 signature of the owner or operator of the designated facility,in violation of California Code of <br /> 22 Regulations,title 22 section 66262.42(a); <br /> 23 g. Failing to submit an Exception Report to the Department of Toxic Substance <br /> 24 Control within forty-five(45)days of the date the waste was accepted by the initial transporter <br /> 25 without a copy of the manifest with the handwritten signature of the owner or operator of the <br /> 26 designated facility,in violation of California Code of Regulations,title 22 section 66262.42(b); <br /> 27 h. Failing to inspect areas used for container storage or transfer, at least weekly, in <br /> 28 violation of California Code of Regulations,title 22 section 66265.174; <br /> -2- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
