1 delivered to the San Joaquin County Office of the District Attorney,Environmental Crimes Unit,at <br /> 2 time of signing: <br /> 3 $2,500.00 made pLL able to the DEPARTMENT OF TOXIC SUBSTANCE <br /> 4 CONTROL—TOXIC SUBSTANCE CONTROL ACCOUNT; <br /> 5 $1,250.00 made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL <br /> 6 HEALTH DEPARTMENT—ENVIRONMENTAL HEALTH DIVISION TRUST;and <br /> 7 $1,250.00 made payable to the SAN JOAQUIN COUNTY OFFICE OF THE <br /> 8 DISTRICT ATTORNEY. <br /> 9 7. Defendant shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS (§5,000.00),as <br /> 10 and for civil penalties,pursuant to Business and Professions Code sections 17206. Said payments <br /> 11 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 12 Joaquin County Office of the District Attorney,Environmental Crimes Unit, at time of signing. <br /> 13 8. Defendant shall be penalized,as and for civil penalties,pursuant to Business and <br /> 14 Professions Code sections 17200 et seq.,in addition to those civil penalties set forth in paragraphs 6 <br /> 15 and 7,TWENTY THOUSAND DOLLARS ( 0,000.00). However,it is stipulated by all parties that <br /> 16 the entire additional TWENTY THOUSAND DOLLARS ($20,000.00),in civil penalties shall be <br /> 17 stayed for a period of five(5)years on the following conditions: <br /> 18 a. Defendant will not violate Health and Safety Code sections 25100 et seq., as <br /> 19 described in paragraph 3 above; <br /> 20 b. Defendant will not violate Health and Safety Code sections 25500 et seq., as <br /> 21 described in paragraph 4 above; <br /> 22 c. Defendant will not violate or engage in any of the unlawful acts of unfair <br /> 23 competition as set forth in the First and Second Causes of Action of the Complaint filed in this <br /> 24 action,as well as any other violations of the Business and Professions Code sections 17200 et seq., <br /> 25 including but not limited to Health and Safety Code sections 25100 et seq., and 25500 et seq.. <br /> 26 9. The TWENTY THOUSAND DOLLARS ($20,000.00)in civil penalties, described in <br /> 27 paragraph 8 above, shall immediately be due and payable as set forth in paragraph 8 above,if the San <br /> 28 Joaquin County Office of the District Attorney files Declarations that Defendant violated Health and <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
