A facility shall provide <br /> appropriate containment and/or diversionary structures or equipment to prevent a discharge. The entire <br /> containment system, including walls and floor, must be capable of containing oil and must be constructed so that <br /> any discharge from a primary containment system will not escape the containment system before cleanup occurs. <br /> Immediately update the SPCC plan to include the secondary containment for the 55 gallon waste diesel drum. <br /> This is a repeat violation, Class It. <br /> 613 CFR 112.7(c) Failure to provide appropriate secondary containment,diversionary structures or equipment. <br /> The secondary containment wall for the four AST's has noticeable damage on the west side.According to Gurpreet <br /> Johal,the secondary containment wall was hit by a truck.A wooden wall was observed supporting the secondary <br /> containment wall. A facility shall provide appropriate containment and/or diversionary structures or equipment to <br /> prevent a discharge. The entire containment system, including walls and floor, must be capable of containing oil <br /> and must be constructed so that any discharge from a primary containment system will not escape the containment <br /> system before cleanup occurs. Immediately provide adequate secondary containment for all aboveground <br /> petroleum storage containers 55 gallons or larger. <br /> This is a repeat violation, Class Il. <br /> 618 CFR 112.7(e), 112.8(c)(6)Failed to conduct inspections or integrity tests or maintain records for 3 years. <br /> Copies of inspection and testing records for the last three years were not found on site. Gurpreet Johal stated that <br /> testing and inspections were not being completed. Inspections and tests must be conducted in accordance with the <br /> written procedures developed in the Spill Prevention, Control, and Countermeasure(SPCC)Plan. Records of these <br /> inspections and tests must be signed by the appropriate supervisor or inspector and kept on site with the SPCC <br /> Plan for a period of three years. Immediately begin conducting required inspections and testing and maintain <br /> records on site for three years. <br /> This is a repeat violation, Class II. <br /> 619 CFR 112.7(f)(1) Failed to train personnel on discharge prevention. <br /> Oil handling personnel were not trained.The SPCC plan did not address training.At a minimum, oil handling <br /> personnel shall be trained in the operation and maintenance of equipment to prevent discharges;discharge <br /> procedure protocols;applicable pollution control laws, rules, and regulations;general facility operations;and the <br /> contents of the Spill Prevention, Control, and Countermeasure Plan.
