The secondary containment structure is to contain the maximum capacity of a single <br /> compartment of the tanker truck servicing th facility. No such structure was observed at the facility and facility were <br /> unaware of such a structure.The owner or operator or an onshore or offshore facility subject to this section must <br /> prepare in writing and implement a Spill Prevention Control and Countermeasure Plan. Implement the SPCC plan <br /> as written or amend to plan to reflect the facilities procedures and practices. <br /> This is a minor violation. <br /> 301 CFR 112.5(a) Failed to amend Plan as necessary. <br /> The facility contacts and facility phone numbers need to be updated.The SPCC plan references Sears Holding <br /> Company Environmental Operations Manual and emergency contact phone numbers, Sears is no longer the parent <br /> company. The plan describes a 500 gallon used oil container as being single walled with a concrete dike as <br /> secondary containment, a 500 gallon used oil double walled was observed.The Spill Prevention, Control, and <br /> Countermeasure(SPCC)Plan must be amended when there is a change in the facility design, construction, <br /> operation, or maintenance that materially affects its potential for a discharge,within 6 months of the change, and <br /> implemented as soon as possible, not later than 6 months following preparation of the amendment. Immediately <br /> make all necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently in <br /> place at the facility. <br /> This is a minor violation. <br /> 302 CFR 112.5(b) Failed to review Plan once every five years and/or implement any resulting amendments. <br /> The Spill Prevention, Control, and Countermeasure(SPCC)Plan was last reviewed on 9/12/2005. A review and <br /> evaluation of the SPCC Plan must be conducted at least once every 5 years. As a result of this review and <br /> evaluation,the SPCC Plan must be amended within 6 months of review, and recertified by a Professional Engineer <br /> if any technical amendments were made. Immediately conduct a review of the facility SPCC Plan and make any <br /> necessary amendments. <br /> This is a Class II violation. <br /> 618 CFR 112.7(e), 112.8(c)(6) Failed to keep records of procedures, inspections,or integrity tests for three years. <br /> None of the tanks are currently being inspected as per the SPCC plan. Inspections and testing shall be conducted <br /> on all aboveground liquid petroleum containers larger than 55 gallons, including all 55 gallon drums of oil. Records <br /> of these inspections and tests shall be signed by the appropriate supervisor or inspector and kept on site with the <br /> Spill Prevention, Control, and Countermeasure(SPCC) Plan for a period of three years.
