We at Antonini Enterprises LLC will work diligently to meet all of your requirements and
"return to compliance". In your report you listed improvements that Antonini needs to adhere to per
regulation. You listed violations and explained what we need to do to comply with regulations. Your
report listed a time frame to complete violation correction and to document correction to you by August
30, 2010. We can't meet that timeline. We do expect to work on all violations systematically and
document to you every stage of compliance as soon as possible. We must ask for more time as it has
become apparent to me that our SPCC is not addressing our operation in a true and accurate way and
we can be more in compliance with the regulation by updating some parts of our SPCC plan.
§112.5 Amendment of Spill Prevention, Control, and Countermeasure Plan by owners or
operators.
If you are the owner or operator of a facility subject to this part, you must:
(a)Amend the SPCC Plan for your facility in accordance with the general requirements in§112.7,and with any
specific section of this part applicable to your facility, when there is a change in the facility design, construction,
operation,or maintenance that materially affects its potential for a discharge as described in§112.1(b). You must implement any
amendment as soon as Possible but not later than six months following preparation of any amendment You must
document your completion of the review and evaluation, and must sign a statement as to whether you will amend the
Plan either at the beginning or end of the Plan or in a log or an appendix to the Plan The following words will suffice
"I have completed review and evaluation of the SPCC Plan for(name of facility) on(date) and will (will not) amend
the Plan as a result."
;Vwadurg ;www u Scwiee Si4ee 1926
PO Box 8468• Stockton,CA 95208-0468• Phone(209)466-9041• Fax(209)466-1411
