A Tier I Qualified Facility Plan for the on site petroleum storage was not available for review during the inspection. The owner/operator must certify: (i) Familiarity with the requirements of this part; (ii)Visitation and examination of facility; (iii)Plan preparation in accordance with accepted and sound industry practices and standards, and with requirements of this part; (iv)Procedures for required inspections and testing have been established; (v)Full implementation of the Plan; (vi) It meets qualification criteria set forth under 40 CFR 112.3(g); (vii) No deviation from any requirement of this part as allowed by 40 CFR 112.7(a)(2)and 112.7(d), except as provided in paragraph (c)of this section; and (viii)The Plan and individual(s)responsible for implementing the Plan have the full approval of management and facility owner or operator has committed the necessary resources to fully implement the Plan. Immediately write and certify a Tier I Qualified Facility Plan for this facility, implement the plan, keep a copy on site and submit a copy of the complete plan to the San Joaquin County Environmental Health Department. US EPA has Tier I templates available for this purpose. This is a minor violation. Overall Inspection Comments: The facility has a 1000 gallon gasoline tank, 500 gallon diesel tank, one 55 gallon drum of product oil, and three 55 gallon drums of used oil. The petroleum capacity is greater than 1320 gallons so the Aboveground Petroleum Storage Act(APSA)applies to this facility. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by November 16, 2018.
