The letter states that; "the following violations exist on your property " <br />Section code: 9-1905.8 SJCO — Operating without a land use permit. <br />Upon reading the notice and ordinance, I appeal the notice herein and the appeal will address the <br />following: <br />1. Operating without a land use permit - <br />Per the Site Approval application, Step 44, Business Licenses <br />If the project involves a business, a Business License must be approved <br />prior to starting operation. Business license applications can be <br />processed concurrently with a Site Approval Application. <br />First, I appeal to you to evaluate our Site Approval Application PA -1600240. <br />Based on the Site Approval Application that we submitted on October 5, 2016 we <br />proposed to run a full chipping and grinding site including opening our gates to <br />prospective customers, hiring employees, digging a well, and septic, and placing a <br />HCD approved mobile office. None of these items have been started at this site. <br />Since Green Earth Recovery (GER) had not begun to operate our business, we wish <br />to reserve our appeal rights and request an appeal hearing, and since we have been <br />forcibly removed from the site (as discussed below), we want to have the notice <br />released and, if not released, preserve our right to appeal. Phelan Development submitted a Site Approval <br />
