According to Ms. Sass, the person <br /> previously designated for discharge prevention is retired and the task has not been reassigned. The Spill Prevention, <br /> Control, and Countermeasure (SPCC) Plan shall designate a person at the facility who is accountable for discharge <br /> prevention and who reports to facility management. Immediately designate a person to be accountable for discharge <br /> prevention and update the SPCC Plan to include this information. <br /> This is a Class II violation. <br /> 616 CFR 112.7(f)(3) Failed to schedule and conduct discharge prevention briefings at least annually. <br /> Discharge prevention briefings are not scheduled at least once a year. According to Ms. Sass, SPCC training is <br /> conducted for new hires, but has not been reconducted annually for the employees. Discharge prevention briefings for <br /> oil handling personnel must be scheduled and conducted at least once a year to assure adequate understanding of <br /> the SPCC Plan for that facility. Such briefings must highlight and describe known discharges or failures, <br /> malfunctioning components, and any recently developed precautionary measures. Immediately schedule and conduct <br /> a discharge prevention briefing, ensure that they are scheduled and conducted at least once a year. <br /> This is a repeat violation, Class II. <br /> 706 CFR 112.8(c)(2) Failed to provide and maintain adequate secondary containment. <br /> A 250 gallon diesel tank for the emergency fire pump was observed with insufficient secondary containment. <br /> According to the SPCC Plan the 250 gallon diesel tank does not have secondary containment and none was <br /> observed. All bulk storage tanks must be provided with a secondary means of containment for the entire capacity of <br /> the tank and sufficient freeboard to contain precipitation. Immediately provide sufficient secondary containment for this <br /> and all other tanks at this facility. <br /> This is a Class II violation. <br /> 713 CFR 112.8(c)(6) Failed to perform scheduled tank tests and inspections by appropriately qualified personnel. <br /> The aboveground tanks on site were not tested for integrity. According to the SPCC Plan, a monthly inspection <br /> should be done by the site, an external inspection every five years and an internal inspection shall be conducted every <br /> ten years. Each aboveground container shall be tested and inspected for integrity on a regular schedule and whenever <br /> repairs are made. The qualifications of personnel performing tests and inspections, frequency and type of testing and <br /> inspections that take into account container size, configuration, and design shall be determined in accordance with <br /> industry standards. Examples of these integrity tests include, but are not limited to: visual inspection, hydrostatic <br /> testing, radiographic testing, ultrasonic testing, acoustic emissions testing, or other systems of non-destructive <br /> testing. Comparison records and other records of inspections and tests must be maintained on site.
