Failed to amend SPCC Plan within 6 months, or implement changes within 6 months of amendment when there is an applicable change to the facility. A new diesel emergency generator approximately 250 gallons located by the dry grocery building was installed within the past 5 years. It was not found in the inventory on Table 5 of the SPCC. Amend the Plan when there is a change in facility design, construction, operation or maintenance that materially affects its potential for discharge as described in CFR 112.1(b). Changes includes but not limited to: de/commissioning containers, replacement, reconstruction, or movement of containers; reconstruction, replacement, or installation of piping systems; construction/ demolition that may alter secondary containment structures, changes of products/ service; revision of standard operation or maintenance procedures at facility. Amendments must be made within 6 months, implemented as soon as possible, but not later than 6 months following preparation of the amendment. Correct by adding the installed diesel emergency generator to the inventory and site map. # 10. Failed to complete a review and evaluation of the SPCC Plan at least once every 5 years. SPCC Plan document was produced in May 2005. No documentation of review and evaluation of Plan was found throughout the Plan. Correct by completing a review and evaluation of the SPCC Plan at least once every 5 years. Document that a review and evaluation was done on the Plan, and sign a statement whether you will amend the Plan, either at the beginning or end of the Plan or in a log or appendix to the Plan. Following words will suffice, "I have completed review and evaluation of the SPCC Plan for (facility name) on (date), and will/will not amend the Plan as a result." Correct by adding the above information to the Plan. # 11. Failed to have Professional Engineer (PE) certify technical amendments within 6 months. The addition of the emergency generator located by the dry grocery building requires a PE certification. Technical amendments is when there is a change in facility design, construction, operation, or maintenance that affects its potential for discharge. Correct by having a PE certify this technical amendment. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122).
