CLASS 11. or MINOR - Notice to ComoM Item # Remarks 115 CCR 2715(a) Failed to inform the EHD of a change of designated operator within 30 days. An Owner Statement of Designated UST Operator Compliance has not been submitted to CERS. Any changes shall be reported to the EHD by submitting to CERS within 30 days. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov and upload the notification identifying all the designated operators for this facility. This is a Class II violation. 207 CCR 2715 Designated operator did not inspect all required items and/or the inspection reports not completed. The designated operator failed to check and note the correct test dates for the triennial secondary containment testing o the designated operator monthly inspection reports. The date written on the reports is the previous test date of Septemb 27, 2010. This testing was conducted on September 24, 2013. During the monthly inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and document the dates they were done. Ensure that designated operators performing monthly inspections at this facility are including all of the required information on the reports. This is a Class II violation. The designated operator failed to verify that all employees have been trained during the November 2013, March 2014, A 2014, May 2014, June 2014, August 2014, and September 2014 monthly inspection. This section of the reports was left blank. During the monthly inspection, the designated operator shall verify that all facility employees have been trained. Ensure that designated operators performing monthly inspections at this facility are including all of the required informati, on the reports. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by November 5, 2014. Consent to perform the inspection, take photos and collect samples was given by Steve Kempton, General Manager. This facility's designated operator is Thomas Lee Hingston II (]CC expiration date: 10/19/14) . The service technician was Ed Stearns (ICC expiration date: 11/27/14), who had the following manufacturer's certifications: VMI (exp. 6/24/15). The Veeder-Root Level 4 certification was not available for review on site. If this certification cannot be verified, the testing will need to be redone by a properly certified technician. All EHD staff time associated with a reinspection will be billed at the current hourly rate ($130). Please be aware that as of January 1, 2014, facility operators are required to upload the following UST program documents into the California Environmental Reporting System (CERS): UST Monitoring Site Plan, UST Certification of Financial Responsibility, UST Response Plan, UST Owner/Operator: Written Agreement (if applicable), UST Letter from Chief Financial Officer, and Owner Statement of Designated UST Operator Compliance.
