The <br />generator manifest copy shall be submitted to DTSC for every shipment on a manifest when California is either the <br />generator state or the destination or consignment state. The generator manifest copy shall be mailed to: <br />DTSC Generator Manifests <br />P.O. Box 400 <br />Sacramento, CA 95812-0400 <br />Immediately mail a copy of all uniform hazardous waste manifests and ensure that copies of all generator manifests <br />are sent to DTSC within 30 days of shipping hazardous waste. <br />This is a repeat violation, Class II. <br />201 <br />HSC 25163(a) Transported or transferred hazardous waste to a transporter without valid registration. <br />On September 23, 2014, the following items were observed being shipped back to Toys R Us from PAC Trucking, a <br />transporter used by Toys R Us: One box of Coppertone sunscreen, cocoa butter lotion, hand sanitizer, lotion, and <br />baby powder, including two bottles of open baby lotion. <br />During the same inspection, it was found that PAC Trucking was receiving hazardous wastes, including damaged <br />items, from Toys R Us. An invoice from ACT for waste pickup was observed at PAC Trucking identifying the <br />"purchase order" as Toys R Us for "Nickel Cadmium batteries (Dry Cell)," dated April 1, 2014. Six 5 gallon buckets <br />of hazardous waste batteries from Toys R Us were observed on site at PAC Trucking at that time. According to Mr. <br />Tony Evans, this facility does not open the boxes that are returned to them from stores and transporters unless it is <br />obviously damaged or labeled as trash. The containers are sorted and sent to one of two packing streams. <br />Transportation of hazardous waste shall be performed only a person that holds a valid registration issued by the <br />Department of Toxic Substances Control to transport hazardous waste. Immediately begin using a registered <br />hazardous waste hauler to transport any generated hazardous wastes. <br />This is a Class I violation. <br />Page 5 of 9 <br />
