Environmental Health Department <br />Aboveground Petroleum Storage Act Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />SOUSAS CUSTOM HARVESTING <br />20178 E GAWNE RD, STOCKTON <br />July 16, 2018 <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />Item # <br />Remarks <br />102 <br />HSC 25270.4.5(a) Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br />This facility has an Aboveground Petroleum Storage Act (APSA) regulated shell capacity of approximately 15,000 <br />gallons. A Spill Prevention, Control, and Countermeasure (SPCC) Plan was not available on site. All facilities which <br />have an APSA regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets <br />all of the requirements of the 40 CFR Part 112. This plan shall be certified by a professional engineer in accordance <br />with 40 CFR 112.3(d). Immediately prepare a SPCC Plan in accordance with 40 CFR Part 112, which that includes <br />all aboveground petroleum storage containers 55 gallons or larger. Submit a copy of the Professional Engineer <br />(PE) certified SPCC Plan to the EHD for review. (This copy will be returned to the facility after review.) A copy <br />shall be maintained on site at all times. <br />This is a Class II violation. <br />701 <br />CFR 112.8(b)(1) Failure to ensure drainage from diked areas is restrained by valves or alternative method. <br />The secondary containment was observed without a proper drainage valve. The containment area had a pipe at the <br />base of the retention wall with not valve or a way to stop the flow of product. Manual, open -and -closed designed <br />valves shall be used for the drainage of diked areas. Immediately install the correct type of valves to be used for the <br />drainage of diked areas and amend the SPCC Plan as necessary, or provide equivalence as allowed by CFR <br />112.7(a)(2). <br />This is a minor violation. <br />706 <br />CFR 112.8(c)(2) Failed to provide and maintain adequate secondary containment. <br />The used oil and new oil containers by the side of the office were observed without secondary containment. All bulk <br />storage tanks must be provided with a secondary means of containment for the entire capacity of the tank and <br />sufficient freeboard to contain precipitation. Immediately provide sufficient secondary containment for this and all <br />other tanks at this facility. <br />This is a Class II violation. <br />718 <br />CFR 112.8(c)(11) Failed to locate properly or provide sufficient secondary containment for mobile/portable <br />containers. <br />The new oil 55 gallon drums next to the office were observed without secondary containment. Portable oil storage <br />containers must be positioned or located to prevent a discharge and shall be furnished with a secondary means of <br />containment sufficient to contain the capacity of the largest single container with sufficient freeboard to contain <br />precipitation.
