Facility has an APSA regulated shell capacity of 1860 gallons. No Spill Prevention & <br />Countermeasure Control (SPCC) Plan was available on site. All facilities which have an APSA regulated <br />shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of the <br />requirements of the Code of Federal Regulations, Part 112. This facility qualifies as a Tier I facility which <br />has no aboveground oil storage container with capacity >5,000 gallons. Immediately prepare a SPCC <br />Plan in accordance with CFR Part 112, which will include all aboveground petroleum storage containers <br />55 gallons or larger. Submit a copy of self -certified SPCC Plan to the EHD for review by 04/28/11 . A <br />template for Tier I can be found on SJC EHD website under the program Aboveground Petroleum <br />Storage Act. (This copy will be returned to the facility after review.) A copy shall be maintained on site at <br />all times. <br />Submit to SJC EHD within 30 days (04/28/11)- <br />1. one copy of the completed "Return to Compliance Certification" form <br />2. a written corrective action statement for the above violations <br />ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY <br />RATE.
