The facility has two 1000 gallon <br /> above ground fuel tanks for gasoline and diesel. The facility is moving and leaving the fuel tanks on <br /> the property. There are no new businesses scheduled to move into the site. <br /> OBSERVATIONS/COMMENTS: <br /> The operator stated that the tanks contain residual fuel of less than 100 gallons each and will no longer be used by F&H <br /> Construction. <br /> These tanks are regulated under APSA (California Health & Safety Code 25270). Requirements include a Spill <br /> Prevention Control and Countermeasures (SPCC) plan and periodic inspections. <br /> These tanks can be removed from APSA regulation by putting the tanks into "permanent closure" as defined by Code of <br /> Federal Regulations (CFR) Title 40 section 112.2. Note that when the tanks are placed back in service they are once <br /> again regulated by the Environmental Health Department(EHD) under APSA. <br /> CORRECTIVE ACTIONS: <br /> The property owner and operator must do one of the following: <br /> 1) Put the tanks into permanent closure by removing all liquid and sludge from the tank. Dispose of waste from the tank <br /> as hazardous waste. Send a copy of the disposal manifest/receipt to the EHD. <br /> Disconnect and blank off all piping. Close and lock all valves. Leave the vent pipe open. Place a sign on each tank <br /> stating "permanently closed"with the date of closure. Notify the local fire department of the tank closure. <br /> 2) Move the tanks to another property. Provide the destination address to the EHD. <br /> 3) Place the tanks back into service at the current property and follow the SPCC plan including periodic inspections. In <br /> this case, the tanks will remain regulated by the EHD under APSA.
