(AGE) is notifying San Joaquin County Environmental Health Department (SJCEHD) of its <br /> intent to suspend environmental work at 2050 Fremont Street, Stockton, California (site) . <br /> As SJCEHD may be aware, environmental investigation work at the site is funded via an active <br /> Underground Storage Tank Cleanup Fund (USTCF) Priority Class ` C' claim. Although the claim <br /> for the site has not been suspended, the USTCF recently notified all claimants by letter dated 28 <br /> January 2009, that all Priority Class ` C' claims for reimbursemempayment request will beprocessed <br /> and payments placed on hold pending the availability of funds. The USTCF has proj ected that active <br /> Priority Class ` C ' reimbursements may be delayed up to 30 months. <br /> A 30-month delay in reimbursement payments places a considerable financial burden on FPI. At <br /> this time, FPI is temporarily not financially able to continue environmental work at the site. When <br /> reimbursement payments become more timely, FPI will resume work and pursue closure of the site. <br /> FPI is currently working to petition the USTCF to change the priority class from Priority Class ` C ' <br /> to Priority Class `B ' . This process includes proving Priority Class B qualification for the original <br /> claimant (Assignor), Mr. Lawrence Beasely; FPI is the "Assignee" of the claim. Upon successful <br /> change of priority class, Fremont Plaza Investments hopes to resume work dependent on the <br /> financial health of the USTCF. <br /> The fourth quarter ground water monitoring and sampling event was recently completed in <br /> December 2008 . The report has been drafted by AGE and is currently under review. The report will <br /> be published and submitted to SJCEHD on schedule. <br /> FPI understands and desires to complete the work at the site and appreciates SJCEHD temporarily <br /> agreeing to work suspension work until the financial situation of the USTCF improves.
