Open 5 gal bucket of unknown waste: This waste has been emptied into a <br /> solid waste drum. The contents were determined to hold waste fluids that were <br /> abandoned on site by a visitor. The drum in which it was emptied into is on site and has <br /> not been removed from site until it has reached full capacity. It is labeled with the <br /> appropriate yellow hazardous. Waste labels and is properly marked. <br /> 432,Hazardous waste tank assessment: The Company has researched the tank Vs. <br /> the Container regulations. Due to this Container being non stationary and is transportable <br /> and not stationary,the company has determined it to meet the Container regulations and <br /> not that of the Tank Assessment qualification. <br /> #44, Contingency Plan: This plan is currently in development. Will be submitted <br /> by 8-13-2010 if not sooner. Had postponed until after the consultation with NES <br /> representative. <br /> #49, Personal training records: Copy of individual training is provided for review. <br /> Training is ongoing and will be documented as scheduled. <br /> Aboveground Petroleum Storage Act(APSA) Program Inspection <br /> Violation#1,No SPCC plan: Currently Frank C. Alegre is consulting with NES <br /> Network Environmental Systems, Inc. to provide guidance and or possibly provide the <br /> SPCC plan. Upon the completion of this plan,Frank C. Alegre Trucking, Inc. will submit <br /> a copy of this plan to correct the non conformance. Training personnel and management <br /> in the plan will also be ongoing and documented. <br /> I certify that all the responses to each violation are true.
