MERENE <br />Supervisor Steve Gutierrez requested that I respond to your letter dated October 25, 1999, <br />regarding the underground storage tank removal at 1611 South Airport Way, Stockton. It is my <br />understanding that you contest Environmental Health Division, San Joaquin County Public Health <br />Services' requirement for a description of the covering for the soil stockpile and the final soil <br />destination location in the event that contaminated soil is involved. Specifically you request the <br />specific statutory authority that allows the County to require this information in an underground storage <br />tank removal plan. <br />San Joaquin County, Public Heath Services, Environmental Health Division is the local <br />enforcement agency responsible for enforcing and regulating the state statutes and regulations <br />conceming the removal of underground storage tanks and the clean-up and remediation associated with <br />such removal. Prior to removing an underground storage tank a closure plan must be submitted to the <br />local agency for approval. (Cal. Admin. Code, tit. 23, § 2670, subd. (f).) The local enforcement <br />agencies have been delegated the authority to adopt and enforce local standards of performance which <br />may be more stringent than the state regulations. (Health & Saf. Code, § 25299.2.) <br />San Joaquin County, Public Health Services, Environmental Health Division has set local <br />standards of performance which are applied to all tank removal projects. These standards maybe more <br />stringent than the state standards or other local agencies. San Joaquin County currently requires that <br />the initial work plan identify the final destination place for any soil, if contaminated. It is my <br />
