EI Dorado St., Stockton Program: APSA SUMMARY OF VIOLATIONS CLASS I,CLASS II,or MINOR-Notice to Comply) 101. Facility has an APSA regulated shell capacity of 10,000 gallons. No Spill Prevention & Countermeasure Control (SPCC) Plan was available on site. All facilities which have an APSA regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of the requirements of the Code of Federal Regulations Title 40, Part 112. This facility qualifies as a Tier II facility which has no aboveground oil storage containers with a capacity greater than 10,000 gallons. Immediately prepare a SPCC Plan in accordance with 40 CFR Part 112, which will include all aboveground petroleum storage containers 55 gallons or larger. A template for Tier II SPCC Plans can be found on the EHD website under the program Aboveground Petroleum Storage Act. Submit a copy of the properly Professional Engineer (PE) or self-certified SPCC Plan to the EHD for review by June 23. (This copy will be returned to the facility after review.) A copy shall be maintained on site at all times. Complete and submit a copy of the Return to Compliance Certification to the EHD by June 23, 2013 along with a statement documenting the corrective actions that have been or will be taken for each violation and any supporting paperwork. Provided: Return to Compliance Certification form ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
