Manual, open-and-closed designed valves shall be used for the drainage of diked areas. <br /> Immediately install the correct type of valves to be used for the drainage of diked areas and amend the SPCC Plan as <br /> necessary, or provide equivalence as allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 704 CFR 112.8(c)(2) Diked area is not sufficiently impervious to contain discharged oil. <br /> The diesel tank secondary containment has an open drain pipe and is currently not impervious to contain discharged <br /> oil. Diked areas must be sufficiently impervious to contain discharged oil. Immediately provide or repair all diked <br /> areas to be sufficiently impervious to contain oil. <br /> This is a Class II violation. <br /> 706 CFR 112.8(c)(2) Failed to provide and maintain adequate secondary containment. <br /> The 10,000 gallon diesel tank was observed with insufficient secondary containment. The drain pipe on the secondary <br /> containment for the diesel tank is not the closing type, allowing discharges to be released immediately. No <br /> descriptions or calculations were observed indicating that the secondary containment structure contains sufficient <br /> capacity for the full contents of the tank plus freeboard for rainwater. All bulk storage tanks must be provided with a <br /> secondary means of containment for the entire capacity of the tank and sufficient freeboard to contain precipitation. <br /> Immediately provide sufficient secondary containment for this and all other tanks at this facility. <br /> This is a Class II violation. <br /> 707 CFR 112.8(c)(3)(i) Failed to keep containment bypass valves closed when not draining rainwater. <br /> The drain pipe on the secondary containment for the diesel tank is not the closing type, allowing discharges to be <br /> released immediately. Bypass valves that allow drainage of uncontaminated rainwater from the diked area into a <br /> storm drain or discharge of an effluent into an open watercourse, lake, or pond, bypassing the facility treatment shall <br /> be kept closed and sealed. Immediately close all containment bypass valves when not draining rainwater, or provide <br /> equivalence as allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 708 CFR 112.8(c)(3)(ii) Failed to inspect retained rainwater prior to discharge. <br /> The drain pipe on the secondary containment for the diesel tank is not the closing type, allowing discharges to be <br /> released immediately. The rainwater discharge log in the SPCC Plan was blank. Retained rainwater from a diked <br /> area shall be inspected prior to being discharged. Ensure that rainwater is inspected prior to being discharged from <br /> diked areas, or provide equivalence as allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> Page 6 of 8 <br />
