The following is an itemized list of aboveground petroleum storage act violations that <br />have not been addressed for A L POWELL TRUCKING as of May 11, 2018. <br />Open violations from November 29, 2017 inspection <br />Violation #102 - Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br />This facility has an Aboveground Petroleum Storage Act (APSA) regulated shell capacity of greater than <br />1,320 gallons. A Spill Prevention, Control, and Countermeasure (SPCC) Plan was not available on site. <br />All facilities which have an APSA regulated shell capacity of 1,320 gallons or greater shall prepare a <br />written SPCC Plan which meets all of the requirements of the 40 CFR Part 112. This plan shall be <br />certified by a professional engineer in accordance with 40 CFR 112.3(d). Immediately prepare a SPCC <br />Plan in accordance with 40 CFR Part 112, which that includes all aboveground petroleum storage <br />containers 55 gallons or larger. Submit a copy of the Professional Engineer (PE) certified SPCC Plan to <br />the EHD for review. (This copy will be returned to the facility after review.) A copy shall be maintained <br />on site at all times. <br />Violation #106 - Failed to submit a written response within 30 days of receiving an inspection <br />report. <br />An inspection was last done on 10/08/13 and an inspection report was issued identifying information to be <br />submitted to bring this site into compliance. This information was required to be submitted by 11/08/13. <br />Existing violation include: HSC 25270.4.5(a) Failed to prepare a written SPCC Plan in accordance with <br />CFR Part 112. This information has not been received resulting in a non-compliant status for this facility. <br />An operator that receives an inspection report shall have 30 days to submit a written response that <br />includes a statement documenting corrective actions taken or proposing corrective actions which will be <br />taken. Ensure that a written response documenting corrective actions taken or proposed is submitted <br />within 30 days of receiving an inspection report. <br />Open violations from October 08, 2013 inspection <br />Violation #101 - Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br />Three 250 gallon above ground storage tanks containing waste oil, gasoline and kerosene and 10,000 - <br />gallon diesel above ground oil tank were observed at the time of inspection. No SPCC plan could be <br />located onsite the time of inspection. Sandy, the part owner could not recall if the plan was prepared in <br />the past. SPCC Plan should be prepared in accordance with CFR Part 112. Immediately locate a copy of <br />the plan or prepare the plan, maintain it site, and submit the copy to the EHD by November 8, 2013. <br />Open violations from September 29, 2010 inspection <br />Violation #1 - Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br />Facility lack a Spill Prevention Control and Countermeasure (SPCC) plan. Pursuant to Health and Safety <br />Code section 25270.4.5(a) facility did not prepare a SPCC plan according to CFR part 112. Immediately, <br />prepare a SPCC plan certified by a professional engineer (PE) for the facility and submit to the EHD for <br />review within 30 days of receiving this report.
