Plan Review Observation: Facility diagram did not include all required information. Contact list did not include all required agency information(because of this,San Joaquin County Emergency Services was not notified when discharge occurred on June 5,2011). Requirement:40 CFR§112.7(a)(3) Describe in your Plan the physical layout of the facility and include a facility diagram,which must mark the location and contents of each fixed oil storage container and the storage area where mobile or portable containers are located.The facility diagram must identify the location of and mark as"exempt"underground tanks that are otherwise exempted from the requirements of this part under§112.1(d)(4).The facility diagram must also include all transfer stations and connecting pipes, including intra-facility gathering lines that are otherwise exempted from the requirements of this part. 40 CFR§112.7(a)(3)(vi) You must also address in your Plan: Contact list and phone numbers for the facility response coordinator,National Response Center,cleanup contractors with whom you have an agreement for response,and all appropriate Federal, State,and local agencies who must be contacted in case of a discharge as described in§112.1(b). To verify compliance with the SPCC regulations,please provide evidence to our office within thirty(30)days from the date of this letter that demonstrates your facility's full compliance by correcting the SPCC deficiencies listed above. Please be reminded that in the event of an oil or hazardous substance discharge to waters of the United States in violation of Section 311(b)(3)of the Clean Water Act(CWA),33 U.S.C. § 1321(b)(3), the facility owner or operator is required pursuant to Section 311(b)(5)of the CWA,33 U.S.C. § 1321(b)(5),to immediately report all such discharges. Reports must be made to the National Response Center at 1-800-424-8802. Failure to comply with notification requirements may result in both civil and criminal penalties. A separate,and additional,spill reporting requirement to the California Emergency Management Agency(Cal EMA)may be found in the California Health& Safety Code at Section 25270.8.
