Procedures and <br />frequency of testing for these devices were not addressed in the Spill Prevention, Control, and Countermeasure <br />(SPCC) plan. Liquid level sensing devices must be installed in accordance with CFR 112.8 and shall be regularly <br />tested to ensure proper operation. Immediately conduct all necessary testing of liquid level sensing devices, or <br />provide equivalence as allowed by CFR 112.7(x)(2). <br />This is a Class II violation. <br />718 <br />CFR 112.8(c)(11) Failed to provide sufficient secondary containment capacity for mobile or portable containers. <br />The 55 gallon waste diesel drum east of the truck shop and a 55 gallon drum of oily water next to the oil -water <br />separator skim tank were observed with no secondary containment. Portable oil storage containers must be <br />positioned or located to prevent a discharge and shall be furnished with a secondary means of containment sufficient <br />to contain the capacity of the largest single container with sufficient freeboard to contain precipitation. Immediately <br />provide sufficient secondary containment for this and all other portable containers at this facility, or provide <br />equivalence as allowed by CFR 112.7(a)(2). <br />This is a Class II violation. <br />724 <br />CFR 112.8(d)(4) Failed to regularly inspect aboveground valves, piping, and appurtenances. <br />Copies of recent inspection and testing records were not found on site. The most recent inspection forms were dated <br />March 2016. All aboveground valves, piping, and appurtenances shall be regularly inspected. Immediately inspect <br />aboveground valves, piping, and appurtenances and ensure inspections are done regularly, or provide equivalence <br />as allowed by CFR 112.7(a). <br />This is a Class II violation. <br />40 CFR 112.7 - SPCC Plan lacks full approval of management at a level of authority to commit the necessary <br />4010 <br />resources to implement the Plan. <br />The management approval section of the plan was signed by Gary Scannavino who is no longer with the business. <br />The Spill Prevention, Control, and Countermeasure (SPCC) Plan must have the full approval of management at a level <br />of authority to commit the necessary resources to fully implement the Plan. Immediately obtain required management <br />approval for the SPCC Plan for this facility. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />An inspection checklist was provided to the facility operator on the day of inspection. The EHD has written the <br />complete report which replaces the initial checklist. <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />Page 8 of 9 <br />
