Summary Statem to accompany the Retur D Compliance <br />Certification RECEIVED <br />- for - <br />Cherokee Freight Lines FEB 14 2017 <br />5463 E. Cherokee Road ENVIRONMENTAL HEALTH <br />Stockton, California DEPARTMENT <br />In response to the APSA Inspection Report from the San Joaquin County Environmental Health <br />Department, dated 1/13/2017 and amended 1/17/2017. <br />All deadlines referred to in the following summary assume a baseline date of February 16, 2017. <br />201 CFR 112.3(d) Failure to have a licensed professional engineer (PE) properly review and certify <br />the Spill Prevention, Control and Countermeasure (SPCC) Plan. <br />• On February 1, 2017, Cherokee Freight Lines (CFL) retained Condor Earth (Condor) to update <br />the SPCC Plan (Plan) for the Stockton Maintenance Yard (Facility). We anticipate a PE certified <br />Plan to be completed by March 15, 2017. CFL will immediately begin work on additional PE <br />requirements and recommendations such that we can complete work to implement the Plan within <br />6 months of receipt. The San Joaquin County Environmental Health Department (SJCEHD) will <br />be provided a copy of the Plan upon completion of the update. <br />301 CFR 112.5(a) Failed to amend Plan as necessary. <br />• The Plan update will reflect current Facility conditions and will identify containers and <br />equipment with an oil storage capacity of 55 -gallons or more. Future Plan changes/amendments <br />will be logged appropriately. <br />302 CFR 112.5(b) Failed to review Plan once every five years and/or implement any resulting <br />amendments. <br />The Plan update will reflect current Facility conditions. Future Plan reviews, including PE <br />certification, will be completed on a five year interval, if not sooner. <br />303 CFR 112.5(c) Failed to have a professional engineer (PE) certify technical amendments. <br />• This Plan update will be certified by a licensed PE. <br />609 CFR 112.7(a), 112.7(a4) The Plan failed to adequately contain procedures for reporting a <br />discharge. <br />The updated SPCC Plan will contain sections regarding countermeasures, an updated discharge <br />contact list, spill notification, and spill response. Plan appendices will include a spill history form, <br />a spill response plan with reporting forms, and an updated list of cleanup contractors. <br />Page 1 of 3 <br />
