Failed to prepare a SPCC Plan. An owner/ operator of a storage tank shall prepare a Spill <br /> Prevention Control and Countermeasure Plan prepared in accordance with Part 112 of Code of Federal <br /> Regulations. Any container or tank equal to or larger than 55 gallons that contains any percentage of <br /> petroleum will be included in the plan. A facility with a total more than 10,000 gallons of petroleum will <br /> require a Professional Engineer to certification. A facility less than 10,000 but more than 1,320 gallons <br /> can self-certify their plan. Each owner/ operator shall conduct periodic inspections of the storage tank <br /> and container to assure compliance with Section 112. Correct by providing a statement how this will be <br /> completed. <br /> # 7. SPCC Plan not onsite. Maintain a complete copy of the Plan at the facility to be available for review <br /> by inspector. <br /> # 52. Failed to promptly correct visible dischages. In the Oil Storage shed, there are spillages of <br /> petroleum oil and waste absorbent on the concrete floor adjacent to the 55 gallon new oil products and <br /> around the waste oil. The secondary containment of the form oil is nearly full of form oil and water <br /> condensation. Correct by removing visible discharges which results in a loss of oil from the containers <br /> into the appropriate properly labeled containers. Visible discharges includes but not limited to seams, <br /> gaskets, piping, pumps, valves, rivets, and bolts. <br /> Submit to SJC EHD within 30 days (10/21/10): <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement for the above violations <br /> Notes: <br /> - Convault is inspected and documented on a monthly written checklist. <br /> - Convault is served by a balance Phase I vapor recovery system. Gasoline dispensing nozzle served by <br /> a balance Phase II vapor recovery system. Two Fill-Rite FR702 cabinet dispensers. <br /> - Performed vapor recovery system testing. Test type: TP-201.36 (leak decay) done 12/2009. <br /> - Convault installed in 2002 L 2085 "Protected" AST (UL 2085, ULC-S655, ULC-S602 insulated/ <br /> secondary containment meets Uniform Fire Code OF & NFPA 30A). 30 year limited warranty. Contains 2 <br /> Kreuger mechanical level gauges (glass view liquid level sensing device). Two tank top 7 gallon integral <br /> spill containment , overfill prevention valve & camlock fill adapter. Exterior finished w/fuel resistant <br /> epoxy coating (Permacrete). Fuel filters changed every 6 months. Convault is lighted at all times. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122). <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Ins ct Received By: Title: <br /> EHD 23-02-003 Rev 0 10/10 CONTINUATION FORM <br />
