however, a UL 1316 listing/approval does not guarantee that the tank is compatible with biodiesel. The State Water <br />Resources Control Board (State Water Board) adopted regulation providing an option for compliance with existing <br />independent testing and approval and compatibility requirements so that UST owners and operators can store any <br />substance in USTs in a manner that does not create any significant risk of adverse impacts to water. When a UST <br />owner/operator intends to store a substance that is not included in the independent testing organization approval or <br />listing of a component on their UST system, such as biodiesel and a UL listing, the owner/operator must submit to the <br />Certified Unified Program Agency (CUPA) an affirmative statement of compatibility from the manufacturer of that <br />component for the specific substance being stored, including blend ratio. At a minimum the statement of compatibility <br />should include the manufacturer(s) name, specific model or part number, containment type, current independent <br />testing organization standard/approval, dates of manufacture, size, and the specific substance and blend that is <br />compatible. This ability to use an affirmative statement of compatibility from the manufacturer in conjunction with the <br />independent testing organization approval to satisfy the compatibility requirement is limited to containment and <br />components of double-wall UST systems. (California Code of Regulations, section 2631(k).) <br />All primary containment including any integral secondary containment systems must demonstrate compatibility. Tanks <br />of all USTs installed before January 1, 1991, piping on all USTs installed before July 1, 1992, and all other components on <br />all USTs installed before January 1, 1995 are required to demonstrate compatibility with biodiesel in one of the following <br />ways: 1) an independent testing organization approval in accordance with industry codes, voluntary consensus <br />standards, or engineering standards that explicitly includes a rating for biodiesel or biodiesel mixtures; or 2) an <br />affirmative statement of compatibility from the manufacturer of the UST containment and components that specifies <br />the acceptable ethanol concentration. <br />For all UST systems, in the event that non -integral secondary containment is used, it shall be designed and constructed <br />according to an engineering specification approved by a state registered professional engineer or according to a <br />nationally recognized industry code or engineering standard. The engineering specification shall include the construction <br />procedures. Materials used to construct the secondary containment system shall have sufficient thickness, density, and <br />corrosion resistance to prevent structural weakening or damage to the secondary containment system as a result of <br />contact with any released biodiesel. <br />For applicable leak detection equipment for biodiesel please refer to the link below. <br />http://www.waterboards.ca.gov/water issues/programs/ust/leak prevention/18113/misc/biodiesel eg.shtml <br />As far as the Federal UST requirements, which apply to all UST systems, for tank, piping, containment sumps, and release <br />detection equipment they should be being met if state requirements are met. For pumping equipment, spill equipment, <br />and overfill equipment the federal rule requires either: <br />(i) A certification or listing of UST system equipment or components by a nationally recognized, independent testing <br />laboratory for use with the regulated substance stored; or <br />(ii) An Equipment or component manufacturer approval. The manufacturer's approval must be in writing, indicate an <br />affirmative statement of compatibility, specify the range of biofuel blends the equipment or component is compatible <br />with, and be from the equipment or component manufacturer. <br />These extra federal requirements will eventually become state requirements when the State's UST regulations are <br />amended to be at least as stringent as the federal requirements so that UST owners/operators only need to meet state <br />requirements to meet federal requirements as well. <br />These records are to be maintained for as long as the substance is stored. <br />Feel free to inquire further if necessary. <br />Cory Hootman, P.E. <br />Water Resource Control Engineer <br />State Water Resources Control Board, Division of Water Quality <br />
