Routine Aboveground Petroleum Storage Tank inspection 1, 7. Facility has an APSA regulated shell capacity of 3355 gallons. No Spill Prevention & Countermeasure Control (SPCC) Plan was available on site. All facilities which have an APSA regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of the requirements of the Code of Federal Regulations, Part 112. This facility qualifies as a Tier I facility which has no aboveground oil storage container with capacity >5,000 gallons. Immediately prepare a SPCC Plan in accordance with CFR Part 112, which will include all aboveground petroleum storage containers 55 gallons or larger. Submit a copy of self -certified SPCC Plan to the EHD for review by 02/11/11. A template for Tier I can be found on SJC EHD website under the program Aboveground Petroleum Storage Act. (This copy will be returned to the facility after review.) A copy shall be maintained on site at all times. Submit to SJC EHD within 30 days (02/11/10): 1. one copy of the "Return to Compliance Certification" form 2. a written corrective action statement how and approximately when a SPCC Plan will be completed ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPICY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
