MacArthur Dr., Tracy Program: APSA SUMMARY OF VIOLATIONS CLASS I,CLASS II, or MINOR-Notice to Comply) "The following issues were noted based on the review of the SPCC Plan (submitted in response to the July 15, 2010 inspection) conducted on December 22, 2010.*' -- The Professional Engineer (PE) certification is incomplete. The certification is contingent upon upgrades that had not yet been completed. The PE certification must include all of the aspects in 40 CFR Part 112.3(d)(1), including attesting that the PE is familiar with 40 CFR 112, he or his agent has visited and examined the facility, the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, procedures have been established for required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a complete PE certification for the facility's Spill Prevention Control and Countermeasure (SPCC) plan. -- The inventory listed in the SPCC Plan does not include the 250 gallon diesel generator, 1500 gallon baler, 250 gallon hydraulic oil tank, and 800 gallon pit tank (oily water). During the July 15, 2010 inspection, the facility contact indicated that the unleaded fuel was kept in a split tank with a 750 gallon compartment and a 250 gallon compartment; the SPCC Plan lists a single 1000 gallon unleaded tank. Discharge & drainage controls and potential equipment failure are not addressed for any of the unlisted containers. The SPCC Plan must include the correct type of oil and storage capacity of each fixed storage container, and either the type of oil and storage capacity of each portable container or an estimate of the potential number of portable containers, types of oil, and anticipated storage capacities. The Plan must include discharge or drainage controls, such as secondary containment around all containers and other structures, equipment, and procedures for the control of a discharge, and a prediction of the direction, rate of flow, and total quantity of oil which could be discharged as a result of each type of major equipment failure. Immediately update the inventory and discharge information in the SPCC Plan to accurately represent the petroleum storage at the facility. -- The phone number for the San Joaquin County Environmental Health Department (EHD) is not included in the contact list. The California Office of Emergency Services has changed its name to California Emergency Management Agency (Cal EMA). The SPCC Plan must include a contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors with whom you have an agreement for response, and all appropriate federal, state, and local agencies who must be contacted in case of a discharge. Immediately update the contact list to include the most current version of the required information. -- Figure 1 (map of the storm drain inlets) could not be located in the SPCC Plan. Immediately include all referenced documents with the SPCC Plan. ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122).
