MacArthur Dr., Tracy Program: APSA <br /> SUMMARY OF VIOLATIONS <br /> CLASS I,CLASS II, or MINOR-Notice to Comply) <br /> "The following issues were noted based on the review of the SPCC Plan (submitted in response to the <br /> July 15, 2010 inspection) conducted on December 22, 2010.*' <br /> -- The Professional Engineer (PE) certification is incomplete. The certification is contingent upon <br /> upgrades that had not yet been completed. The PE certification must include all of the aspects in 40 <br /> CFR Part 112.3(d)(1), including attesting that the PE is familiar with 40 CFR 112, he or his agent has <br /> visited and examined the facility, the Plan has been prepared in accordance with good engineering <br /> practice, including consideration of applicable industry standards, procedures have been established for <br /> required inspections and testing, and the Plan is adequate for the facility. Immediately obtain a <br /> complete PE certification for the facility's Spill Prevention Control and Countermeasure (SPCC) plan. <br /> -- The inventory listed in the SPCC Plan does not include the 250 gallon diesel generator, 1500 gallon <br /> baler, 250 gallon hydraulic oil tank, and 800 gallon pit tank (oily water). During the July 15, 2010 <br /> inspection, the facility contact indicated that the unleaded fuel was kept in a split tank with a 750 gallon <br /> compartment and a 250 gallon compartment; the SPCC Plan lists a single 1000 gallon unleaded tank. <br /> Discharge & drainage controls and potential equipment failure are not addressed for any of the unlisted <br /> containers. The SPCC Plan must include the correct type of oil and storage capacity of each fixed <br /> storage container, and either the type of oil and storage capacity of each portable container or an <br /> estimate of the potential number of portable containers, types of oil, and anticipated storage capacities. <br /> The Plan must include discharge or drainage controls, such as secondary containment around all <br /> containers and other structures, equipment, and procedures for the control of a discharge, and a <br /> prediction of the direction, rate of flow, and total quantity of oil which could be discharged as a result of <br /> each type of major equipment failure. Immediately update the inventory and discharge information in the <br /> SPCC Plan to accurately represent the petroleum storage at the facility. <br /> -- The phone number for the San Joaquin County Environmental Health Department (EHD) is not <br /> included in the contact list. The California Office of Emergency Services has changed its name to <br /> California Emergency Management Agency (Cal EMA). The SPCC Plan must include a contact list and <br /> phone numbers for the facility response coordinator, National Response Center, cleanup contractors <br /> with whom you have an agreement for response, and all appropriate federal, state, and local agencies <br /> who must be contacted in case of a discharge. Immediately update the contact list to include the most <br /> current version of the required information. <br /> -- Figure 1 (map of the storm drain inlets) could not be located in the SPCC Plan.
