<br /> 201. The Professional Engineer (PE) certification is incomplete. The certification did not include
<br /> statements about visiting the facility, industry standards, inspections and testing, or the adequacy of the
<br /> Plan. The PE certification must include all of the aspects in 40 CFR Part 112.3(d)(1), including attesting
<br /> that the PE is familiar with 40 CFR 112, he or his agent has visited and examined the facility, the Plan
<br /> has been prepared in accordance with good engineering practice, including consideration of applicable
<br /> industry standards, procedures have been established for required inspections and testing, and the Plan
<br /> is adequate for the facility. Immediately obtain a complete PE certification for the facility's Spill
<br /> Prevention Control and Countermeasure (SPCC) plan. Submit a copy of the completed, certified SPCC
<br /> plan to the EHD by October 20, 2012.
<br /> 301. After a leak in the pipes, the facility switched from periodic painting of the piping to PVC tape wrap
<br /> for corrosion protection; the Plan was not amended to include this change. The SPCC Plan must be
<br /> amended when there is a change in the facility design, construction, operation, or maintenance that
<br /> materially affects its potential for a discharge, within 6 months of the change, and implemented as soon
<br /> as possible, not later than 6 months following preparation of the amendment. Immediately make all
<br /> necessary amendments to the SPCC Plan to accurately represent the procedures and policies currently
<br /> in place at the facility.
<br /> 303. The SPCC Plan was last reviewed on October 11, 2001. A review and evaluation of the plan must
<br /> be conducted at least once every 5 years. You must document your completion of the review and
<br /> evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or
<br /> end of the Plan, or in a log or appendix to the Plan. The following words will suffice:
<br /> "I have completed the review and evaluation of the SPCC Plan for (name of facility) on (date), and
<br /> will (will not) amend the Plan as a result."
<br /> As a result of this review and evaluation, the SPCC Plan must be amended within 6 months of review,
<br /> and recertified by a professional engineer if any technical amendments were made. Immediately
<br /> conduct a review of the facility SPCC Plan and make any necessary amendments.
<br /> 501. A cross-reference is not included in the SPCC Plan. If you do not follow the sequence specified in
<br /> 40 CFR 112 for the Plan, you must prepare an equivalent Plan and supplement it with a section cross-
<br /> referencing the location of requirements in 40 CFR 112 and the equivalent Plan. Immediately amend
<br /> the Plan to include an accurate cross-reference or to follow the required sequence.
<br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE.
<br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT END'S CURRENT HOURLY RATE.
