Stockton January 20, 2016 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item # Remarks <br /> 102 HSC 25270.4.5(a) Failed to properly close a tank that is considered permanently closed. <br /> The gasoline tank on the north side of the property is not in use but has not been properly closed. When a tank is <br /> not in use, it must be permanently closed by meeting the following conditions: <br /> - remove all liquid and sludge from each container and connecting line <br /> -disconnect and blank off all connecting lines and piping have from the tank <br /> -close and lock all valves <br /> - post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br /> Immediately "Permanently Close" all tanks that are not being used or amend the Spill Prevention, Control, and <br /> Countermeasure Plan to include all petroleum tanks that have not been permanently closed. <br /> This is a minor violation. <br /> 202 CFR 112.3(e)(1) Failed to maintain a copy of the Plan on site. <br /> A copy of the Spill Prevention, Control, and Countermeasure (SPCC) Plan was not available at the time of <br /> inspection. The owner or operator must maintain a complete copy of the SPCC Plan at the facility if the facility is <br /> normally attended at least four hours per day, or at the nearest field office if the facility is not attended, and have the <br /> Plan available for on site review during normal business hours. Immediately locate a copy of the SPCC Plan for this <br /> facility and maintain a copy at or near the facility. Submit a copy of the SPCC Plan to the EHD for review. <br /> This is a Class II violation. <br /> 301 CFR 112.5(a) Failed to amend Plan as necessary. <br /> -The SPCC Plan incorrectly stated that the tank gauge is "directly visible during loading and unloading activities". <br /> The tank gauge was facing away from the loading pipe and would not be viewable during loading operations. <br /> -The SPCC Plan incorrectly stated that the facility has surveillance cameras. According to Mr. Dugger and <br /> documents on site, the cameras on site are fake. <br /> -The SPCC Plan lists three different clean up contractors in different sections of the Plan. According to Mr. Dugger, <br /> APEX is the clean up contractor for the site. <br /> -The SPCC Plan listed two different people as the "spill prevention manager" -Christopher Chan and Greg <br /> Andrews. According to Mr. Dugger, he has never heard of a Christopher Chan. <br /> The Spill Prevention, Control, and Countermeasure (SPCC) Plan must be amended when there is a change in the <br /> facility design, construction, operation, or maintenance that materially affects its potential for a discharge, within 6 <br /> months of the change, and implemented as soon as possible, not later than 6 months following preparation of the <br /> amendment.
