Stocktor January 20, 2016 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item # Remarks <br /> 701 CFR 112.8(b)(2) Failed to use manual open-and-closed design valves for the drainage of diked areas. <br /> The drain pipe from the tank secondary containment is permanently open, with no valve. Manual, open-and-closed <br /> designed valves shall be used for the drainage of diked areas. Immediately install the correct type of valves to be <br /> used for the drainage of diked areas and amend the SPCC Plan as necessary, or provide equivalence as allowed by <br /> CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 706 CFR 112.8(c)(2) Failed to provide and maintain adequate secondary containment. <br /> The fuel tank was observed with insufficient secondary containment. The drain pipe from the tank secondary <br /> containment is permanently open, with no valve. All bulk storage tanks must be provided with a secondary means <br /> of containment for the entire capacity of the tank and sufficient freeboard to contain precipitation. Immediately <br /> provide sufficient secondary containment for this and all other tanks at this facility. <br /> This is a Class II violation. <br /> 708 CFR 112.8(c)(3)(ii) Failed to inspect retained rainwater prior to discharge. <br /> The drain pipe from the tank secondary containment is permanently open, with no valve. Retained rainwater from a <br /> diked area shall be inspected prior to being discharged. Ensure that rainwater is inspected prior to being <br /> discharged from diked areas, or provide equivalence as allowed by CFR 112.7(a)(2). <br /> This is a Class II violation. <br /> 710 CFR 112.8(c)(3)(iv) Failed to maintain records of drainage from diked areas. <br /> Records of drainage of uncontaminated rainwater from diked areas were not found on site. Adequate records (or <br /> NPDES permit records)of drainage from diked areas shall be retained. Immediately begin maintaining adequate <br /> records(or NPDES permit records) of drainage from diked areas. <br /> This is a minor violation. <br /> 713 CFR 112.8(c)(6) Failed to perform scheduled tank tests and inspections by appropriately qualified personnel. <br /> Integrity testing records were not available for the fuel tank. Each aboveground container shall be tested and <br /> inspected for integrity on a regular schedule and whenever repairs are made. The qualifications of personnel <br /> performing tests and inspections, frequency and type of testing and inspections that take into account container <br /> size, configuration, and design shall be determined in accordance with industry standards. Examples of these <br /> integrity tests include, but are not limited to: visual inspection, hydrostatic testing, radiographic testing, ultrasonic <br /> testing, acoustic emissions testing, or other systems of non-destructive testing. Comparison records and other <br /> records of inspections and tests must be maintained on site.
