Madruga Rd. <br /> Lathrop, CA 95330 <br /> SUBJECT: 100 Gallon diesel Spill at 1500 E. Madruga Rd.,Lathrop CA,(APN 24141037) <br /> The San Joaquin County Environmental Health Department(EHD)conducted an inspection on October <br /> 14,2008, of the above referenced property for an emergency response for a reported spill of approximately <br /> 100 gallons of diesel fuel that occurred on October 13,2008. The spill went up the vent line of the above <br /> ground storage tank(AST)and onto the roof of the structure covering the AST. The diesel fuel ran down <br /> the roof and into the rain gutters and down spouts and into the soil underneath the down spouts. The <br /> response team for the fuel delivery company excavated some of the soil from underneath the two eastern <br /> down spouts. See attached photos. <br /> On October 17, 2008 the responsible party hired NRC to finish removing the rest of the contamination on <br /> the roof and in the soil. They took a confirmation soil sample and the results of which are pending. Due to <br /> the physical characteristics of the soil and shallow depth to ground water,our office is referring this spill to <br /> the proper agencies to determine if any further action is necessary. <br /> Violation: Please be advised that disposal of hazardous waste at an unauthorized point is a <br /> violation of Health and Safety Code§25189.5. <br /> Corrective Action: The EHD is referring the oversight of the investigation and cleanup to the <br /> Department of Toxic Substances Control(DTSC) and the Central Valley Regional Water Quality <br /> Control Board(CVRWQCB). Please contact Tim Miles of DTSC at(916)255-3710 to determine <br /> proper oversight. <br /> A"Notification of Hazardous Waste Discharge"report was filed on October 14,2008 with the DTSC and <br /> the CVRWQCB pursuant to Health and Safety Code§25180.7.
