(AGE) has prepared this letter <br />to request a temporary suspension of quarterly ground water monitoring at wells MW -1 through <br />MW -11 at Ralph's Square, 2122 South Airport Way, Stockton, California (site). <br />Mr. Peter Minh Bui has not yet received a letter of commitment (LOC) from the California State <br />Water Resources Control Board (SWRCB) Underground Storage Tank (UST) Cleanup Fund. Mr. <br />Peter Minh Bui was recently notified by the UST Cleanup Fund that the State would be delayed as <br />many as 18 months issuing new LOC's. Due to the significant costs of monitoring activities at the <br />site, Mr. Peter Minh Bui has accrued over $114,000 of monitoring expenses. <br />The accrued costs for the quarterly ground water monitoring have caused a great financial hardship <br />on Mr. Peter Minh Bui. Furthermore, based on the current conditions at the state, it is unlikely that <br />Mr. Peter Minh Bui will receive an LOC from the UST Cleanup Fund before February of 2010. <br />Ralph's Square does not have the financial capabilities to continue quarterly ground water <br />monitoring activities at the site until Mr. Peter Minh Bui receives an LOC for the site and <br />reimbursement from the UST Cleanup Fund commences.
