Mr. But attended the
meeting as scheduled. Ms. Lan Nguyen also attended the meeting as Mr. Bui's interpreter. Mr. White
did not attend the meeting.
PHS/EHD explained to Mr. Bui that he has been named as a responsible parry because he was the last
known operator of the former USTs at the site. Responsible parties are required to perform corrective
action pursuant to California Code of Regulations, Title 23, Division 3, Chapter 16, Article 11. Mr. But
stated he had attempted to communicate with Mr. White about PHS/EHD requirements, but had no
response from Mr. White. Ms. Nguyen suggested Mr. But try to resolve the problem with Mr. White
through mediation. Mr. Bui requested a month to attempt mediation with Mr. White and have a work
plan submitted. Therefore, a work plan to investigate the extent of the contamination at the site is to
be submitted to PHS/EHD by July 6, 1999. Failure to submit this work plan by this date will result in
a PHS/EHD request for formal enforcement action by the San Joaquin County District Attorney
Office.
If you have any questions contact Jeffrey Wong at (209) 468-0335.
Donna Heran, REHS, Director
Environmental Health Division
Co v
Jeffrey Wong, REHS
LOP/Site Mitigation Unit IV
C.
