Airport Way <br /> Stockton, CA <br /> This letter is to clarify that laws regarding construction, maintenance, testing, and use of <br /> underground storage tanks (UST's) used for the storage of hazardous substances were enacted <br /> in January 1984. Regulations for UST's were first adopted in January 1985. <br /> The UST's previously operated at the above referenced site were removed in January 1982 <br /> according to the information in the San Joaquin County Environmental Health Department <br /> (EHD)files. At that time there were no requirements to demonstrate that no unauthorized <br /> release (leak) had occurred based on soil sample analysis and/or water analysis if water was in <br /> the tank excavation. In addition, there is currently no regulatory requirement for property <br /> owners of sites where UST's were located prior to 1984 to show that the site is not <br /> contaminated. <br /> EHD has identified Ultramar Inc. as a responsible party for the above referenced site since they <br /> owned and operated the UST's immediately before the discontinuation of their use. In addition, <br /> EHD identified Sayed & Zakia Abdelwahed as responsible parties for the site since they are the <br /> owner of property,where an uanauthorized release from an UST has occurred. The definition of <br /> a responsible party is contained in the California Underground Storage Tank Regulations <br /> (California Code of Regulations, Title 23, Division 3, Chapter 16) Section 2720.
