<br />jllii I�I' 2 Some or all of the above equipment has been, or may have been, used for the storage or
<br />transportation of petroleum products, including, but not limited to, petroleum products containing tetra-
<br />ethyl lead Buyer should take notice that material intended either for human or animal consumption or as
<br />III an ingredient in any product intended for such consumption should not be stored in tanks or containers
<br />which have contained petroleum products containing tetraethyl lead
<br />3 Due to the nature of the materials which may have been stored or transported in the
<br />INN" equipment to be delivered hereunder, certain residues of such materials may still be contained in, or
<br />be present on, the equipment Such residues may be FLAMMABLE, POISONOUS, and/or
<br />HAZARDOUS
<br />4 The equipment should not be exposed to excessive heat or to open flame, nor should machining,

<br />i'i welding, or cutting of the equipment be performed until and unless the equipment is first thoroughly
<br />ill �i cleaned and all traces of hazardous substances removed, as, for example, by steam cleaning or equivalent
<br />li process
<br />5 It is further expressly understood and agreed that Buyer assumes all risk of, and releases Seller
<br />from any and all liability for, injury to, or death of, any person, or damage to any property arising out of or
<br />in connection with the traInsportation, handling' instillation, use, modification, or destruction of any or .ill
<br />ul� of the equipment
<br />6 Buyer shall indemnify, defend and hold Seller harmless from and against any and .ill loss,
<br />cost, damage, expense (including attorneys' fees), or liability to any person (including Buyer or Buyer's
<br />ydirectly or
<br />employees) for death, personal injury or damage to property (Including Buyer's properl) di
<br />indirectly caused either by the equipment or by its use Buyer s obligation hereunder shall not di affected
<br />or diminished by any negligent act or failure to act by Seller or by Seller's agents or employees which may
<br />have contributed, or is alleged to have contributed, in whole or in part, to said loss, cost, damage, expense,
<br />or liability, not by the application of the legal doctrine of strict liability in tort to Seller or to Seller's agents
<br />or employees (or the application of any other legal doctrine which imposes liability in the absence of
<br />common law or statutory
