Ci, Spanos Tet Center received a NOVICE OF <br /> REQUIREMENT OREIMBURSE with respect to the above referenced site, together <br /> with a cover litter from Sam Joaquin..County Public Health Services,Environmental <br /> Health Division(EHD),announcing assignment for oversight with respect to Site 1845. <br /> Neither document informed Petitioner that it had any petition rights; <br /> 2. The most immediate resultof the above notification was a meeting held on April <br /> 12; 1995,at the direction of and at the office of EH t that meeting,we inquired of <br /> EHD as to the basis for the NOTICE. use were informed by EHD that,according to the <br /> definition contained in the administrative guidelines that EMI was following,we were a <br /> "Responsible Party" We expressed our opinion that we were not a responsible party: <br /> v'e were invited by EHD to submit whatever documentation andar9 uments1we belie ed <br /> would support fur position.
