To require the Spanos Jet Center to expend time and money in investigation and corrective action <br /> for a spill that has not been shown to have occurred at-a time when it used the tanks is unfair and <br /> contrary to the law. To ask it to respond to laws which were effective only after its use is <br /> similarly wrong. To ask it to respond to events which occurred as long as fifty years ago and not <br /> sooner than five years ago is contrary to the limitations of law. <br /> Petitioner believes that the County of San Joaquin has a conflict of interest in acting as theLocit...,, <br /> Agency. Since it is also the owner of the Site, it clearly is in its best interest to involve as many <br /> other parties as possible in the corrective action process.
