Box 60 ENVIRONMENTAL HEALTH <br /> Tracy, CA 95378 PERMIT/SERVICES <br /> NO FURTHER ACTION DETERMINATION, EFFECTIVE DATE, FORMER HOLLY SUGAR <br /> FACILITY, HOLLY DRIVE, TRACY, SAN JOAQUIN COUNTY <br /> In a 26 May 2010 letter, the Central Valley Regional Water Quality Control Board (Central <br /> Valley Water Board) Executive Officer issued a Conditional No Further Action Determination to <br /> you in regards to the Former Holly Sugar Facility in Tracy (Site). The Conditional No Further <br /> Action Determination stated that the effective date of this Determination will be issued to you <br /> after Central Valley Water Board staff receives proof of recording of the deed restriction and <br /> documentation that the monitoring wells were destroyed with San Joaquin County <br /> Environmental Health Department (County) approval and oversight. <br /> In a letter dated 3 September 2010, you provided documentation demonstrating that the deed <br /> restriction was recorded with the San Joaquin County Recorder's Office. In addition, on <br /> 14 December 2010 you provided documentation that the monitoring wells were destroyed on <br /> 22 October 2010 with County oversight. Therefore, the No Further Action Determination for <br /> this Site is effective as of the date of this letter. <br /> Issuance of a No Further Action Determination does not preclude future action by the Central <br /> Valley Water Board if subsequent monitoring, testing, or analysis at the Site indicates that the <br /> remedial action standards and objectives were not achieved; a new or previously undiscovered <br /> release occurs at the Site; or new information indicates that further site investigation and <br /> remedial action are required to prevent a significant risk to human health and safety, the <br /> environment, or water quality.- - <br /> If you have questio7 about this letter, you may call Kristi Shelton at (916) 464-4819. <br /> N 0 - <br /> K.J.
